Reduced penalties for Class MA and MB licences

The maximum fine a court may impose for an offence against the Security Industry Act 1997 (Act) and Security Industry Regulation 2016 (Regulation) is reduced by 75 per cent if the offence is committed by a Class MA or Class MB Master security licensee.

This does not apply to offences against section 7(1)(b) of the Act where the licensee provides more persons on any one day than authorised by their Master licence.

New offences and penalties

Several new offences and changes to some penalties commenced on 1 June 2023. New offences include:

  • obstructing an enforcement officer
  • failing to comply with a requirement of an enforcement officer
  • altering, damaging or destroying records and other things
  • providing false or misleading information
  • conspiring to commit an offence
  • inducing the commission of an offence.

Publication of offences and licence revocations

SLED is authorised to publish information about licence revocations and enforcement action we take for offences committed under the Act or Regulation. This does not apply to an offence dealt with by issuing a penalty notice of $5000 or less.

The information that may be published about an offence is:

  • the name of the person who committed the offence
  • the date of the offence
  • the action taken in relation to the offence
  • any other information prescribed by Regulation.

The information that may be published about a licence revocation is:

  • the name of the person whose licence was revoked
  • the reason(s) for the revocation
  • the date on which the licence was revoked
  • any other information prescribed by Regulation.

This information can be made publicly available once all proceedings related to an offence or a revocation are finalised, including any appeals.
