The following statement applies to the collection, use, disclosure and handling of personal information collected by New South Wales Police Force (NSW Police Force) via our Community Portal website (the Site).
As a NSW government agency, we must meet the requirements of the Privacy and Personal Information Protection Act 1998(the Act). However we are not required to comply with the Act unless the NSW Police Force is exercising administrative or educational functions.
The primary purpose of this Site is for members of the public to report minor crimes and therefore is not in the exercise of NSW Police Force’s administrative or educational functions. Anonymous reports of crime are not permitted; we require members of the public to provide their name and contact details when reporting a crime, in order to assist us with our investigations.
You will be responsible for the Content included in any communications that you submit to this Site or otherwise to NSW Police Force, including its truthfulness and accuracy. You acknowledge that, where you submit any Content to or via this Site, any statement made by you accurately sets out the evidence which you would be prepared, if necessary, to give in court as a witness. Any such statement must be true to the best of your knowledge and belief and you make it knowing that, if it is tendered in evidence, you shall be liable to prosecution if you have wilfully stated in it anything which you know to be false, or do not believe to be true.
You must ensure that any Content that you submit to the Site is not offensive, indecent, discriminatory, abusive, harassing or pornographic and does not infringe the rights, including intellectual property rights such as copyright, of any person.
Use of Your Content
You grant to NSW Police Force a non-exclusive, perpetual, irrevocable, royalty-free licence (including a right of sub-licence) to access, use and reproduce any Content submitted by you to this Site, including but not limited to Content that you submit in the course of reporting a crime. This licence extends to draft versions of a crime report saved on the Site, regardless of whether you later submit a final version of such a report.
The Content and format of the Site may be changed by the NSW Police Force at any time, without notice, in its absolute discretion. This Site is intended for use by residents of Australia only. The Site and its Content are governed by the laws in force in New South Wales, Australia.
