The legislation regulating firearm use in New South Wales comes from the Firearms Act 1996 and the Firearms Regulation 2006. It is the responsibility of all firearms licence and permit holders, particularly Firearms Dealers, to have a good working knowledge of this legislation. The Firearms Act 1996 defines a "firearms dealer" as a person who, in the course of carrying on a business or in carrying out their duties as a club armourer or theatrical armourer: (a) manufactures, purchases, transfers, tests, repairs, converts firearms or firearms parts; and (b) possess firearms and firearms parts for the purpose of manufacturing, purchasing, transferring, testing, repairing or converting them. The main difference between a Firearms Dealer (including a Theatrical Armourer) and a Club Armourer licence is that a Club Armourer is not engaged in a business and can only undertake activities incidental to their duties as the Club Armourer of an approved firearms club. Club Armourers do not have authorised employees. In all other respects the legislative, record keeping, security and reporting requirements for Club Armourers are essentially the same as those of a Firearms Dealer. Firearms Dealer - Theatrical Armourer licence holders carry on a business of providing firearms for the purposes of film, television or theatrical productions. A Theatrical Armourer licence authorises the licence holder and authorised employees of the licence holder to instruct and supervise actors and other persons involved in film, television or theatrical productions. The Theatrical Armourer licence also authorises actors and other persons involved in the production to possess and use firearms, but only under the supervision and control of the Theatrical Armourer or authorised employee of the armourer. In all respects, the legislative, record keeping, security and reporting requirements for a Theatrical Armourer are the same as those of a Firearms Dealer.
